Appeal court sitting in Calabar, capital of Cross River State, yesterday granted a formal “Stay of Execution Order” which according to the court reaffirms all candidates contesting elections in the state on the platform of All Progressives Congress APC.
The court stated that it has reaffirmed names of Senator John Owan-Enoh, Senator Ndoma-Egba and names of other persons which the Independent National Electoral Commission,INEC published.
A panel of three Judges led by Justice A. M Uwade frowned at the Independent National Electoral Commission’s (INEC) misinterpretation of her earlier order of February 20 which directed parties in the matter to maintain “Status Quo Ante” pending determination of the substantive case.
The judges who sat in the panel unanimously agreed that the ‘Stay of Execution Order’ earlier granted subsists in the interest of justice as evident in the affidavit and counter affidavit which is contained in the subject matter of the appeal, suit no; CA/C/62/2019.
